Official Rules

Open Only to U.S. Legal Residents

1. INTRODUCTION: “The Ugliest Kitchen” Contest is sponsored by Classic Marble and Granite and New Flooring Creations in conjunction with Glenn Mechanical, Evers Electric, Lighting Designs by Lisa, Sherwin Williams, KLBQ Radio Station, Prothro Construction, LLC, and Artattack of El Dorado, Arkansas.

2. SWEEPSTAKES PERIOD: Entries for “The Ugliest Kitchen” Contest may be submitted beginning on September 1, 2009, and ending on September 30, 2009, at 5:00 PM CST (the "Promotion Period"). All entries must be received during the Promotion Period. One (1) Grand Prize winner will be selected by random drawing to be conducted on or about October 3, 2009. By participating, you agree to these Official Rules. Restrictions apply as provided below.

3. PRIZES: The Grand Prize will consist of new granite countertops, a new sink, new flooring, updated existing cabinets, lighting, painting, which may include but is not limited to materials, labor and installation.

4. PRIZE RESTRICTIONS: All taxes, fees, and insurance expenses, if any, are the sole responsibility of the winner. No prize substitution, cash substitution, assignment or transfer of the prize is permitted.

5. ELIGIBILITY: "The Ugliest Kitchen" Sweepstakes is open only within Union County, Arkansas, to legal residents who are 18 years of age or older at the time of entry as confirmed by a valid government-issued photo identification. All entrants must own their own home. Those who rent are ineligible. Employees of all sponsors are not eligible.

6. HOW TO ENTER: NO PURCHASE NECESSARY.

1. Visit www.marbleexperts.net and click the button on the home page that will take you to the entry form. Complete the entry form on the home page to enter. A photo of the kitchen must be submitted through the web form, or mailed to Classic Marble & Granite (2411 Hinson Rd, El Dorado, AR, 71730).
2. Visit one of the sponsor locations and fill out an entry form. Entries made at sponsor locations must have a photo of the kitchen attached.

By completing the entry form, you are agreeing to be notified by e-mail or phone if you are the winner of the “The Ugliest Kitchen” Contest. All parts of the entry form must be filled out completely; incomplete or illegible entries, or entries received through impermissible or illegitimate channels, are void. Only one (1) entry per person is permitted. Duplicate entries will be voided. You may not exceed this limit by entering with different contact information. Entries are not valid unless the entry form is completed properly and a photo of the kitchen is attached, whether entering at www.marbleexperts.net or at sponsor location. Entrants are agreeing that Classic Marble & Granite may inspect their kitchen for soundness of cabinets and floors. Entries are the property of Classic Marble and Granite and will not be returned. In the unlikely event Classic Marble and Granite encounters technical or equipment failures such as computer systems failure or human error in connection with the sweepstakes, Classic Marble and Granite will not be held responsible. Collection and handling of personally identifiable information will be in accordance with the Classic Marble and Granite Privacy Policy.

7. SELECTION OF WINNERS: Winner will be selected in a random drawing conducted by Classic Marble and Granite from all eligible and valid entries received. Odds of winning depend upon the number of entries received. Winner will be notified within ten (10) days of the drawing by phone or email address provided on winner's entry form. Before receiving any prize and as a condition of receiving such prize, the winner will be required to complete and return an affidavit of eligibility and a liability and publicity release within fourteen (14) days of attempted delivery. By accepting the prizes, the winner agrees that Classic Marble & Granite, its subsidiaries, affiliates, distributors, advertising and promotional agencies and suppliers and all of their respective officers, directors, employees, representatives and agents shall have no liability for, and shall hold all such parties harmless against any claim, damage, loss or injury that may arise in whole or in part, directly or indirectly, from the acceptance, possession, use or misuse of prizes or participation in this Sweepstakes. Classic Marble and Granite will furnish to the Internal Revenue Service any required tax reporting forms relating to the award of the prize including Form 1099-MISC if required.

8. MISCELLANEOUS: This sweepstakes is subject to all applicable federal, state, provincial and local laws. Void where prohibited: you may not participate in any state or jurisdiction where this sweepstakes is prohibited by law. Classic Marble and Granite shall be entitled to interpret these rules as needed - including but not limited to rules regarding entries, selection of winner, deadlines, restrictions on the prize, and eligibility - and all of its decisions are final. By entering, you agree to these conditions. You agree that Classic Marble and Granite, and any subsidiaries and affiliates, and their consultants, agencies and employees, and any telephone network or service provider shall not be responsible for incorrect, inaccurate or incomplete transcription of entry information; for lost, stolen, late, or misdirected entries; for incorrect e-mail addresses or bounced-back e-mail messages; for destruction or alteration of entries; for unauthorized access to entries; or for any human error, technical malfunction, delay in operation or transmission, lost data, omission, interruption, deletion, defect, communications line failure, computer equipment, software, inability to access any web site or online service, or any other error or malfunction. Proof of sending an entry will not be deemed to be proof of receipt by Classic Marble and Granite.

9. VIOLATIONS OF RULES: Classic Marble and Granite reserves the right, at its sole discretion, to disqualify any individual it reasonably suspects or believes to be tampering with the entry process or the award mechanism, whether on-line or by any other means, or to be acting in violation of these rules.

10. LIMITATION ON LIABILITY: You agree that Classic Marble and Granite and any of its sponsors, as well as any of their consultants, agents and employees, and any service provider will not be liable for any claim, injury, loss or damage of any kind (including but not limited to damage to computer equipment) resulting from participation in this sweepstakes or the acceptance or use of the prize. You further agree that Classic Marble and Granite and any sponsors are not responsible for typographical or other errors in the offer or administration of this sweepstakes, including but not limited to errors in advertising, the Official Rules, the selection and announcement of the winner or the distribution of the prize. Classic Marble and Granite reserves the right to modify these rules for clarification purposes without materially affecting the terms and conditions of the sweepstakes.

11. IMPAIRMENT OF INTEGRITY OF SWEEPSTAKES: If for any reason this sweepstakes or any portion thereof is incapable of running as planned because of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, strike, act of God, or any other cause beyond the control of Classic Marble and Granite, Classic Marble and Granite reserves the right, at its sole discretion and without obligation or prior notice, to cancel, terminate, modify or suspend the affected part of the sweepstakes. In such event, Classic Marble and Granite will conduct a drawing to award the prize using all entries received as of the time of cancellation, termination, modification or suspension.

12. WINNER'S NAMES: Winners’ name will be posted on the Classic Marble and Granite’s website at www.marbleexperts.net for a minimum of 14 days, after which it may be removed.

13. PRIVACY POLICY: Subject to the third sentence of this paragraph 13, you specifically acknowledge and agree that Classic Marble and Granite, or any of its sponsors or affiliates, may utilize information obtained from you in order to contact you and/or to offer their products or services or for other promotional purposes, including online announcements, and as otherwise permitted by their privacy policies. That authorization includes authorization to Classic Marble and Granite, or any of its sponsors or affiliates, to provide information about our products and services via email, postal services, fax and telephone. Participant may choose to withdraw entry by notifying in writing Classic Marble & Granite at any time during the promotion period. By accepting a prize, winner consents to the use of his or her name, photograph (including the use and appearance of winner's photograph on the web pages of Classic Marble and Granite, or its sponsors or subsidiaries), likeness, biographical information, voice, and e-mail address in this and future promotions and publicity without further compensation, except where prohibited by law.
